This course will give Occupational Therapists and Occupational Therapy Assistants an overview and update of law and will provide an opportunity to work through case studies to see how the law applies in practice.

Learning outcomes

By the end of this course you will be able to:  



  • Care Act prevention, use of universal/non-commissioned services, eligibility – in relation to OTs, equipment, home adaptations

  • consider legal implications of working and integration with the NHS; legal duties, accountability etc. including NHS Continuing Health Care and OT involvement in assessments and equipment provision

  • clarify the interface between the Care Act 2014 and Housing Grants, Construction and Regeneration Act 1996 (disabled facilities grants) – and note main points of new government guidance on disabled facilities grants (March 2022)

  • review the interface of manual handling (including single handed care/assistive handling, mental capacity and safeguarding

  • note restriction/restraint/deprivation of liberty issues relevant to OTs

  • outline parallel and different duties under the Children Act 1989 and Chronically Sick and Disabled Persons Act 1970

  • understand better the implications of greater integration between health and social care
